The attorney-mediators at Marks Clare & Richards, L.L.C. follow a detailed process in bringing everyone into the process of family conflict or divorce mediation. After speaking to our paralegal, you will fill out a confidentiality form. It is important to know that everything related to your mediation is not a matter of public record. A state-certified mediator is not allowed to testify should the matter go to court later.
In some cases, including divorce, you will also fill out forms that provide information on your assets and debts. Any business interests will have to be assigned a mutually agreed-upon, neutral party for valuation. All this care on the front-end of the process will save you time and cost.
The Mediation Process
After setting the schedule and identifying the issues, the actual process of mediation begins. The attorney-mediators at Marks Clare & Richards, L.L.C. will serve as a neutral party, bringing their legal experience and knowledge to the table. They will facilitate the discussion and help guide the parties towards their own resolution.
Beyond that, their objective is to ensure that a process of healing will begin as well. That starts with both parties knowing that they have controlled the process from the start, and they will have to accept the outcome. In many ways, it is a reality check for one or both sides.
